A lawyer at the highest court of the European Union stated that laws in Britain, France and Belgium, which allow intelligence agencies to randomly collect phone and Internet data for users, violate the EU's privacy rules.

Law enforcement agencies have been facing for a long time a balance between combating terrorism and serious crimes and the right of individuals to privacy of data, and this comes in a set of cases brought by organizations concerned with the protection of privacy in the three countries.

Attorney General Manuel Campos Sanchez-Bordona concluded that European Union rules apply in any setting to impose obligations on companies, including national security concerns.

Bordona pointed out that the French, British and Belgian items require general and random retention of individuals ’data, such as their location and who they call, even though this does not include the contents of electronic exchanges.

In 2016, the European Court of Justice issued a decision that considers the comprehensive collection and retention of contact information inconsistent with European Union law, and the lawyer said that those restrictions aimed at keeping communications confidential must be strictly enforced.
